Atlanta Prison Rape Lawyer
At Harman Law Firm, we are committed to protecting individuals whose rights have been violated under federal law. This includes defending those who have been victimized by sexual assault or rape while incarcerated. All correctional agencies in the United States have a responsibility to maintain specific safety conditions for prisoners, which involves working to prevent, detect and respond to any form of sexual misconduct between inmates or involving prison staff and correctional officers. These mandates are governed by federal law and must be upheld.
Prisons and Jails Have a Duty to Protect Inmates
If your loved one has been the victim of sexual assault or rape in a jail or a prison, turn to Harman Law Firm. We will work hard to expose tolerated misconduct such as prison rape and hold the prison staff responsible for neglecting to uphold the Prison Rape Elimination Act (PREA). We are an experienced law firm that handles many different types of injury claims, including PREA violations. If you or a loved one has been raped in prison, as your lawyer, we will help you understand your rights and explain the severe penalties that exist for this form of neglect or misconduct by jailers.
What is the PREA Act?
The Prison Rape Elimination Act (PREA) was passed unanimously by Congress in 2003 as a Federal law to establish a zero-tolerance policy against sexual assault of incarcerated persons of any age. To law enforcement, this means preventing sexual harassment and rape between inmates as well as between arrestees and prison staff. The PREA was enacted as a direct response to the alarming number of inmates who were being raped in United States prisons each year. Federal funding is still in place to further research and respond to sexual misconduct in prisons across the country.
If you are looking for a law firm that can aggressively represent you or a loved one that has suffered injury due to PREA Violations in a Federal prison or jail, please contact Harman Law Firm for a free consultation. We understand the psychological and physical harm that can exist due to rape by another inmate or prison staff, and we will work hard to present your case in federal or state court.
