Under the national study on violence against women in Georgia (2017):

  • 26% of women reported having experienced sexual violence and/or sexual harassment by a non-partner, including sexual abuse as a child.

  • Sexual intimate partner violence was reported as being 2.3%.

What Is Battery Under Georgia Law?

Under Georgia law, battery is considered a misdemeanor offense unless it is committed against certain individuals, such as a family member, a pregnant person, a law enforcement officer or a person 65 years of age or older. In these cases, the offense may be elevated to a felony charge.

In addition to criminal charges, a person found guilty of battery in Georgia may also face civil liability for any damages caused to the victim. This can include compensation for medical expenses, pain and suffering and other related losses.

What Is Sexual Assault Under Georgia Law?

Sexual assault in Georgia involves non-consensual sexual contact or behavior. Under Georgia law, sexual assault can encompass a wide range of actions, including but not limited to unwanted touching, rape and other forms of sexual misconduct.

It’s important to note that sexual assault can be prosecuted as a separate offense from battery, but in cases where it involves physical harm or violence, it may be prosecuted as both sexual assault and battery.

Georgia Code 16-6-22.1. Sexual battery is when “A person intentionally makes physical contact with the intimate parts of the body of another person without the consent of that person.”

In Georgia, battery and sexual assault are separate offenses under the law. However, in cases where sexual assault involves physical harm or violence, it may be prosecuted as both sexual assault and battery.
